INFORMATIONAL
REPORT ON THE TREATMENT OF DATA
Pursuant
to Article 13 of Legislative Decree 196/03
“Code on
the protection of personal data”
Simiula di Gerardo Iula. informs that the processing
of the personal data submitted shall be subject to the principles of
correctness, lawfulness, transparency, and privacy protection in full respect
of the rights of the concerned party.
The purpose of this informational report is to present
the policy of Simiula di Gerardo Iula. on processing of personal data to the
concerned parties, as well as to illustrate the methods by which such data
shall be treated when one participates, as speaker, auditor, or registered
member, in courses (on-site or distance), meetings, conventions, and events in
general organized and managed by Simiula di Gerardo Iula.
1.Purpose of
the treatment
The data shall be processed exclusively for the
development of the institutional activities of Simiula di Gerardo Iula., for
administrative, accounting, and/or commercial purposes, in particular:
a) to carry out any type of obligation considered and
outlined by the laws, regulations, related commercial standards and uses in
force, in particular, taxation/fiscal matters;
b) to allow the delivery of the services expected by the
participant of an event;
c) to comply with possible requests for information or
for contact that might have arrived through possible data collection modules
arranged by the reception personnel for the events organized by the company, or
even direct requests by intermediates through public contacts on the company
website;
d) to send informative and promotional material relative
to Simiula di Gerardo Iula (as well as through subscription to the newsletter),
in response to a clear request for such material by the concerned party,
arriving through a proper data collection form (in paper and/or electronic
format) submitted to the above-mentioned upon registration in the courses,
meetings, or events of a similar type organized by Simiula di Gerardo Iula.,
and only where the applicant has expressed specific consent regarding that
request.
2.Processing
method
The processing of the data shall be turned over solely
to expressly authorized managers in charge of facilitating the achievement of
the indicated purpose, and shall be carried out by means of the use of manual
paper supports, as well as electronic instruments.
Data processing is intended to be any operation or
series of operations carried out, with or without the aid of electronic
instruments, concerning the collection, registration, organization, conservation,
consultation, processing, modification, selection, extraction, collation, use,
interconnection, blocking, communication, circulation, cancellation, and
distribution of data, even if not recorded in a database.
Personal data subject to processing shall be (Article
11, Legislative Decree 196/03):
a) treated in a legal manner and subject to correction;
b) collected and recorded for specific, explicit, and
legitimate purposes, and used in other processing operations in terms
compatible with such purposes;
c) precise and, if necessary, updated;
d) pertinent, complete, and not excessive with regard to
the purposes for which they were collected or subsequently processed;
e) preserved in a way that allows the identification of
the concerned party for a period of time not to exceed that necessary for the
purposes for which they had been collected or subsequently processed;
The personal data shall be processed using suitable
and preventive security measures in the sense of Article 31 and ff. of
Legislative Decree 196/03 in such a way as to reduce to a minimum the risk of
destruction or loss, unauthorized access, or of processing not conforming to
the purposes of its collection.
In any case, at the end of the data processing,
automatic collection instruments must be used, such as the so-called
"cookies", that will allow the concerned party to benefit from any
personalized services.
Simiula sites uses cookies information for the following general purposes:
to customize the advertising and content you see, fulfill your requests for products and services,
improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.
In such cases (except for advertising banners managed by Google, "Like" buttons manage by Facebook and "Twitter" buttons managed by twitter), the data shall be preserved on Simiula di
Gerardo Iula.'s server, which is located in Italy, where it shall be used for
the purpose of allowing the concerned party to benefit from the services of
Simiula di Gerardo Iula. for the other purposes indicated in this informational
report.

3.Typology
of the treated data
For the purpose of participation as a speaker,
auditor, or registered member in courses (on-site or distance), meetings,
conventions, and events in general organized and managed by Simiula di Gerardo
Iula., processing of common personal data is to be expected.
Moreover, possible processing of sensitive personal
data is to be expected in case of particular demands and/or requests of the
subjects themselves, solely for the purposes that are given in Paragraph 1,
letters a) and b) of this informational report.
4.Submission
of data
The submission of personal data for the achievement of
the purposes cited in Paragraph 1, letters a), b), and c) of this informational
report shall be considered mandatory. Failing to submit the same to Simiula di
Gerardo Iula. will not permit the establishment and improvement of the report,
the provision of services, as well as the processing of possible requests for
information.
It is appropriate to specify that according to Article
24 of Legislative Decree 196/03, the processing performed to fulfil an
obligation provided for by law, regulation, or community standard, as well as
to execute obligations deriving from a contract pertaining to the concerned
party, or to fulfil specific requests of the concerned party himself/herself,
is not subject to the obligation to acquire consent.
The submission of sensitive data for the achievement
of the purposes cited in Paragraph 1, letters a) and b) of this informational
report shall be considered optional. Failing to submit them to Simiula di
Gerardo Iula., however, will not permit the satisfaction of possible particular
demands and/or requests by the concerned party.
Pursuant to Articles 23 and ff. of Legislative Decree
196/03 on the processing of sensitive data, the request for the specific
consent to the processing is required at the time the first formal report is
established or upon first contact. Such consent shall be exercised accepting
the conditions of the formula given at the bottom of the registration form for
the events organized by Simiula di Gerardo Iula.
Submission of sensitive data for the achievement of
the purposes cited in Paragraph 1, letter d) of this informational report shall
be considered optional and does not constitute any limitation on the
establishment of the contractual relationship, or on the reply from Simiula di
Gerardo Iula. to possible requests received through the internet site, except
when it is impossible to keep the concerned parties directly informed of the
activities of Simiula di Gerardo Iula. and/or involve him/her in its possible
particular initiatives.
Pursuant to Article 130 of Legislative Decree 196/03
on the sending of informational and promotional material, the request for the
specific consent to the processing is required at the time the first formal
report is established or upon first contact. Such consent shall be exercised
accepting the conditions of the formula given at the bottom of the registration
form to the events organized by Simiula di Gerardo Iula.
In accordance with the Law regarding the protection of
personal data, and of the standards in force regarding consumer rights, it
shall in any case be possible to object to such processing at the time of
delivery of any promotional communication, making a request to Simiula di
Gerardo Iula. at the address indicated at the end of this informational report,
and receiving a reply from Simiula di Gerardo Iula. to confirm the suspension
of the processing for the purpose in question.
5.Communication
and circulation of data
In the pursuit of the purpose described, the means for
communicating the personal data of the concerned party can involve the
following persons:
a) parties whose authority to access such data is
recognized by legislative measures;
b) our agents and/or suppliers, in the scope of related
duties and/or of possible contractual obligations with them, pertaining to the
commercial relationships with the concerned parties;
c) factoring companies, debt collection companies, credit
insurance companies, private credit bureaus;
d) post offices, carriers, and messengers for delivery of
documentation and/or material;
e) all physical and/or legal persons, public and/or
private (management, legal, administrative, and tax consulting firms; Judicial
Offices; Chambers of Commerce, etc.), when the communications appear necessary
or useful for the development of our activity;
f)
banking
institutions for the management of collections and payments resulting from the
execution of the contracts;
g) parties commissioned and/or charged with development
of activities strictly related to the supply of the services available on the
company website and to the technical maintenance of said site (including
maintenance of the network devices and of the electronic communications
networks);
h) company clients who require common personal data of
the registered members in the course of organization of the events managed
directly by Simiula di Gerardo Iula.
Moreover, further categories of persons to whom
personal data of the concerned party can be transmitted, or who can come into
knowledge thereof, as Managers of processing (if appointed) or Persons in
charge of processing, are:
i)
other
company operating centres (if present);
j)
suppliers,
partners, and third parties in general (hotels, travel agencies, catering
companies, etc.) that require common personal data and, where necessary,
sensitive data, of the registered members in the scope of their organization of
the events and courses presented by Simiula di Gerardo Iula.;
k)
employees
in charge of internal administrative and/or technical management;
l)
information
systems administrators by whom the data are processed.
Finally, the personal data of the concerned party can
be transmitted for other purposes of a commercial nature and, in particular, in
the fields of marketing, market research, or for other commercial initiatives
by third parties in relation to Simiula di Gerardo Iula., with the latter
having stipulated, and/or will have stipulated to commercial agreements.
In such a case the transmission of the personal data
of the concerned party is subject to the specific consent to the communication
by the concerned party himself/herself. Such consent shall be exercised
accepting the conditions of the formula given at the bottom of the registration
form to the events organized by Simiula di Gerardo Iula.
In such a case the consent to the transmission of
personal data is optional.
In no case can the granted personal data be the
subject of circulation.
6.Rights of
the concerned parties
Simiula di Gerardo Iula. guarantees all of the rights
specified in Article 7 of Legislative Decree 196/03, among which are that of
demanding and obtaining the update, rectification, or, if applicable,
integration of data, the cancellation, conversion to an anonymous form or
blocking of data processed in violation of the law, and the right to object,
wholly or partly, for legitimate reasons, to the processing of personal data
regarding the concerned party, even if they are relevant to the scope of the
collection.
7.Legal
matters concerning the processing
The holder of the processing is Simiula di Gerardo
Iula., in the person of the legal representative in office.
The person responsible for all processing is certified
Accountant Gerardo Iula, to whom all requests involving the furnished
information can be sent, accessible by mail and e-mail at the addresses
indicated at the end of this informational report.
